These terms and conditions ("Terms") govern your use of Moments After Dawn Photography ("Website") operated by Amber Herndon ("Photographer", "we", "us", or "our"). By accessing or using the Website, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Website.

Intellectual Property

All photographs, images, and content on the Website are owned by the Photographer and are protected by copyright and other intellectual property laws. You may not reproduce, modify, distribute, or use any content from the Website without prior written permission from the Photographer.

Usage Rights

Clients who purchase or license photographs from the Photographer are granted limited usage rights as outlined in their agreement. Any unauthorized use, reproduction, or distribution of photographs is prohibited.

Payment Terms

Payment terms for photography services are as follows: Payments terms are dependent on what package and add-ons are requested. Remaining payment balance is due day of session. There is a $25 non-refundable retained fee in order to hold the date and time.

Delivery

Photographs will be delivered to clients within 2 weeks following the session or event, unless otherwise specified in the agreement.

Privacy Policy

Our privacy policy outlines how we collect, use, and protect your personal information. By using the Website, you agree to the terms of our privacy policy.

Limitation of Liability

The Photographer shall not be liable for any damages or losses arising from the use of the Website or services provided, including but not limited to indirect, incidental, or consequential damages.

Dispute Resolution

Any disputes arising from these Terms or the use of the Website shall be resolved through negotiation and, if necessary, mediation or arbitration in accordance with Salt Lake County, Utah.

Modifications

The Photographer reserves the right to modify or update these Terms at any time without prior notice. By continuing to use the Website after any modifications, you agree to be bound by the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Salt Lake County, without regard to its conflict of law provisions.
